Release & Waiver of Liability
By checking the box on the Balfe’s Bikes Event sign-up form I acknowledge that I have carefully read and understand the terms and conditions of the event and of this Release & Waiver of Liability.
In order to take part in a Balfe’s Bikes store ride, I waive and release Balfe’s Bikes Ltd, its directors, officers, administrators, representatives and executors, past and present employees, volunteers, agents, supervisors, participants, assigns, all sponsors, their representatives and successors and other persons (collectively, the Releasees) from any and all claims, liabilities, or causes of action arising out of an injury to me and from any and all claims, liabilities or cause of actions arising from my participation in this event.
I voluntarily agree to assume full responsibility for any loss/damage to personal property owned by me or personal injury (including death) as a result of taking part in the event. I understand and agree that none of the parties mentioned (the Releasees) may be held in any way responsible for an accident or incident in connection with a Balfe’s Bikes ride. I agree to release, waive, hold harmless, discharge and covenant not to sue the releasees from all liability, claims, fees, expenses and any course of action whatsoever related to any loss, damage or injury (including death) that may be sustained to me or my property during the ride.
Acceptance of Risk
I accept that bicycling involves a level of inherent risk and danger, including but not limited to: dangers caused by the terrain/road surfaces, facilities, temperature, weather, condition of participants, equipment, road/vehicle traffic, inadequate hydration and actions of other people including, but not limited to other participants, volunteers, monitors, and/or event organisers/producers. I assume all above risks and acknowledge that I may incur minor injuries, major injuries and catastrophic injuries including paralysis and death. I agree to do my part to minimise the risk to both myself and others around me.
I agree to dress appropriately for the conditions/weather and I agree to wear a helmet that satisfies consumer standards throughout the entirety of the ride.
Voluntary Participation
I am aware and accept the risks connected with taking part in the event, whether listed here or not and by signing up voluntarily choose to take part in the event knowing that it involves the risks mentioned.
Equipment requirements
I agree to participate in the ride on a well maintained, road/off-road worthy bike (dependent on the ride) with fully functioning front and rear brakes suitable for riding on public roads. I agree to bring all the necessary tools and equipment to deal with any failures/mechanicals (for example, a puncture). I also agree to bring with me adequate and suitable nutrition for the length of ride described in the event.
I understand that failure to comply with the above may result in my participation being cancelled.
Medical Evaluation
I confirm that I am medically and physically able to participate in the event. If I am or have been recently pregnant, disabled or have suffered any illness injury, I take responsibility of consulting a physician before taking part in the event. I agree to carry any medical supplies that may be needed for conditions specific to me.
I consent to receive medical treatment or transportation in the event of injury to me as medical professionals may deem necessary.
Responsible Riding / Compliance with Rules
Balfe’s Bikes store rides are not a race of any kind, and by participating I accept this fact and acknowledge that I am required to ride responsibly at all times. I also accept that these events hold a no-drop policy and we will ride at the pace of the slowest rider. I accept that I am fully responsible for my own actions while participating in the ride.
I agree to abide by any rules and safety procedures and any decisions/instructions given by ride leaders or event staff at all times. I accept that should my behaviour be deemed dangerous or likely to negatively impact the event, individuals or property of any kind I may be dismissed.
Photography/Videography/Social Media
I acknowledge that images and video may be captured during the event and may be used by Balfe’s Bikes to promote future events on the Balfe’s Bikes website, social media, newsletters and other materials. I hereby grant Balfe’s Bikes permission to use any images and videos on any material of their choosing without limitation.
You will be asked to sign a copy of this waiver at any Balfe’s Bikes store ride.
